Introduction

Brunel are proud to partner with a leading Mining OEM that are looking to grow their capabilities by adding a Commercial Manager.

The successful applicant will manage commercials companywide ensuring all contracts meet legal, commercial and corporate standards/agreed benchmarks. Working with Project Managers and business leaders to provide clear and informed commercial positions and recommendations to manage opportunity and risk.

What are you going to do 

Responsibilities

  • Maintain the consistent quality of contracts and procurement administration and management in alignment with the requirements of the Company's and projects costs, schedule, quality, governance and risk procedures.
  • Monitor and work closely with capital Project Managers to ensure contracts are managed in line with company policy and risk mitigation strategies are in place.
  • Ensure that all contract and procurement management activities are conducted within ethical and Company standards, and in compliance with jurisdictional statutory and regulatory requirements.
  • Establish and maintain appropriate contract terms and conditions and commercial structures to suit each specific scope of work.
  • Create and maintain the commercial exceptions guide book for all sales proposals.
  • Review and drive all commercial discussions at sales level for firm tenders in conjunction with the Capital Sales team, maintaining a reasonable perspective of ensuring commercial success of the tender vs risk mitigation.
  • Develop strategies and provide recommendations on the appropriate actions to mitigate and/or manage disputes, variations and claims.
  • Support the leadership team in the optimal delivery of the project by providing strategic advice and recommendations to improve value and performance for the business.
  • Resolve commercial issues to ensure maximisation of commercial performance on the project, aligned with the commercial strategy and processes of the project. This would include any potential warranty claims.

Essential skills and knowledge 

Requirements:

  • Undergraduate qualification in commerce, business or engineering. Contract Law qualification or similar desirable.
  • Minimum of 5 years' experience in contract and commercial activities
  • International exposure advantageous although not mandatory
  • Broad experience in the formation, negotiation, award and administration of complex contracts and strategic procurement activities
  • Exceptional knowledge of contract law and contract document requirements, with the ability to ensure all contracts meet legal, commercial and corporate standards/agreed benchmarks.
